Collection Agency Law Explained

By Stu Pearson If you have ever been contacted by a collection agency, you know that it can be an unpleasant experience. A collection agency can turn simple acts, such as checking the mail or answering the phone, into dreaded tasks. However, it is important to know that there is a law in place intended to protect the people that collection agencies contact. The FDCPA (Fair Debt Collection Practices Act) was enacted to keep debt collectors from abusing, harassing, or deceiving a person when attempting to collect a debt. It also gives debt collectors strict guidelines to follow when collecting a debt. In this article, we will have this collection agency law explained in simple terms, to better inform debtors of their rights. For starters, the FDCPA outlines very clear practices for debt collectors to follow when contacting a debtor. Debt collectors are only allowed to call during reasonable hours (usually 8:00 a.m. 9:00 p.m.), but they are also allowed to call a debtor at work. However, if the debtor notifies the collection agent that their employer wants the calls to cease, the debt collector must stop calling the persons place of employment. There are also rules of conduct a collection agency must follow when collecting a debt. A debt collector is forbidden from harassing any person from whom they are trying to collect a debt. Examples of harassment include excessively calling, insulting the debtor, or using obscene language. A debt collector is also not allowed to make false statements when collecting a debt. Examples of false statements include posing as a government official, making threats (lawsuits, imprisonment, seizing of home and property, etc.), or telling the debtor they owe more than they actually do. In addition, a debt collector can not use unfair practices in attempting to collect a debt. These practices include collecting an amount larger than what the debtor actually owes, or suing the debtor for a debt they do not owe. The FDCPA requires collection agencies to notify debtors of their rights, and any correspondence (mail or phone) has to contain the information that the contact is being used to collect a debt. The only reason a collection agency can contact a third party (family or friend) is to acquire the debtors phone number or address. If the collection agency has this information, they are forbidden to contact a third party. It is also illegal for collection agencies to tell a third party that they are attempting to collect a debt. The FDCPA is in place to protect the rights of debtors while making a collection agents job clear and concise. If a person being contacted by a debt collector feels that they are experiencing the violations discussed in this article, it is important that these misconducts are accurately documented. The reason for this is so that the claims can be proven if the debtor decides to take legal action. Now that you have had this collection agency law explained, you should feel more confident about your rights if you are ever contacted by a debt collector. It is best to avoid the situation altogether by staying current on your debts, but it is good to know that the FDCPA exists if ever find yourself on the receiving end of a collection call. Understanding Men - Treat Your Man Like A Dog And Get Undying Devotion

By Alison Bennett Ever had a new puppy? Its a tough business getting the best out of your dog so that you both enjoy and love each other. Building that bond of trust and trustworthiness needs work! Understanding puppies is much the same as understanding men. If you let your new dog run free with no thought of discipline or training, there will be poop and puddles all over the house. He will be found humping anything available without a care in the world and hell run away without casting a glance over his shoulder. Youll most probably fine him happily begging for food and attention in the nearest comfortable, inviting abode, If you train your dog properly, hell learn where he can relieve himself and where he cannot. He will know that he cant run around where and with whom he pleases. He will learn not to bite the hand that feeds him. If you go about your training in the right way, with firmness but with plenty of rewards for good behaviour, your dog will become obedient, loving, loyal and your best friend. The bond between owner and dog is one of trust. How can you cultivate this same trust between you and your man? What do you need to do to inspire mutual trust? Here is a list of does and donts: Dont Be A Doormat Dont be a pushover. Let him know where you stand on issue such as slavery, infidelity, lies and being taken for granted. Make it clear, be firm but dont go on and on endlessly about it. Just as you would with a dog, let your man know where your boundaries are. Be Tender And Compassionate And Sometimes Display Tough Love Be loving but never be scared to be tough when necessary. Never let your emotions interfere with your training. No matter how cute and cuddly he is..he is still a dog. Never, Ever, Tell Anyone A Secret Your Man Has Told You. If your man finds out that you have told a secret, that he has shared with you, he will never fully trust you again. In fact, the relationship may well be doomed because it will not blossom into an open relationship where he will tell you everything. Dont succumb to this act of betrayal Never Contradict Or Embarrass Him in Public. He might be acting like a jerk but he is your jerk and loyalty dictates that you dont vent your criticism in public. If you belittle him, especially in front of his friends, he will resent and distrust you. Never Use Things He Tells You Against Him He will never trust and confide in you if he thinks it will ultimately become ammunition. Dont do it. Rein In On Erratic Emotions Men just dont understand wild emotional swings. Neither do dogs. Keep a lid on screaming, hysteria, and general outrageous emotional behaviour. Get yourself some Evening Primrose oil or something for those PMT times. Sexual Trust Consider indulging some of his sexual requests, unless they are too way out or painful. You will probably enjoy it anyway but sexual trust is a big bond builder. Sexual slave? No. Sexual trust? Yes. Okay, bear in the mind the above rules, get a collar, a lead and a pocket of guy treats and go out and train yourself a man. Openers for All Situations

By Joseph Matthews I want to share a story with you all that I thought was interesting. Friday night, I was out with a friend of mine clubbing. As we were walking from one club to another, we saw two women walking together in front of us. These women were HOT! So hot, in fact, that every guy they passed by on the sidewalk tried to talk to them. How did they try this? By saying things like: “Hey, where you going?” “Damn, you fine!” “Hey, come back here, baby!” Needless to say, these girls were completely ignoring each and every guy who talked to them. It’s a harsh reality that most girls who are as hot as these two were get approached by men ALL THE TIME, and have heard every stupid line in the book. In fact, they get approached so much, that they don’t even respond anymore. They’re just focused on getting to where they’re going. So of course, upon seeing this, I thought to myself “How would I approach these girls?” The answer was pretty self-evident. In fact, it was staring me right in the face! The situation was dictating what I should say to them. “Oh my god! Every single guy is trying to pick you guys up! How annoying is that? You guys need to hire BODYGUARDS just to keep all these horny waldos at bay!” This is an example of a SITUATIONAL OPENER. Situational Openers can be the best way to meet a woman if they are done right. This is because this type of Opener is UNIQUE to the interaction you are having with the woman. Not only that, but it shows you guys have a common understanding of the reality you are mutually experiencing. And that, my friends, creates a connection between the two of you. It’s like knowing the punchline to a joke most others have no clue about. And more importantly, this is one of my most favorite kind of situational opener, namely, the “Crash and Burn” opener. This is a situational opener where you capitalize on other men’s failures, while conveying the illusion that you are different from the other guys and are not looking to get into the woman’s pants (even though the truth may be VASTLY different from that which you are conveying). For example, anytime you are in a situation where there are women you want to approach, and you see a guy go up to them and try to hit on them, this gives you the chance to use the “Crash and Burn” opener. Simply walk up to the girl, and comment on what the other guy did wrong. Saying things like: “So, how’d he do?” or “Did it hurt? He was hitting on you pretty hard. Did it hurt?” Or anything along those lines will open up your target for conversation. These types of “Crash and Burn” openers work great in high stimulus environments where girls are being hit on (like bars and clubs, for example). So next time you see some poor schmoe strike out, be sure to take the opportunity to capitalize on it! Until next time! Community Support Transforms Lives of Ex-Offenders

By Lynn Sanders An innovative program called Community Support Advisory Council (CSAC), an initiative of the Illinois Department of Corrections, is helping hundreds of ex-offenders learn how to become productive citizens while providing loving support to their families. The work begins at the Sheridan Correctional Center, dedicated solely to drug treatment in the state of Illinois. Through CSAC, the formerly incarcerated meet with community and block leaders on a weekly basis right in their community, to find ways to re-enter society without returning to crime. James Coleman, Project Director for CSACs Prisoner Re-Entry Services program, is an African-American minister, former chef and a formerly incarcerated individual himself. He helps former prisoners see the possibilities of a new life, from both inside and outside the Sheridan prison. Through his work with CSAC, Coleman serves as a liaison between the corrections system and the community, visiting men while they are in prison, and helping them with support when they return home. He also makes policy recommendations to the Department of Corrections and helps develop best practices which can be duplicated throughout Illinois prisons. Block leaders and other interested community residents can attend a monthly meeting, where they meet with parole officers, police, social service providers and formerly incarcerated individuals, to discuss ways to help the returning inmate keep from returning to a life of crime. At these meetings, formerly incarcerated men are often given awards and citations for staying clean and doing the right thing. CSAC also assists ex-offenders with housing, job leads and other immediate needs. Weekly Overcomers Group Meetings offer ex-offenders and their families an opportunity to share their troubles and find support from each other and the broader community. Its really about relationship building, explains Coleman, with a ready smile. Sixty percent of the population in the Sheridan prison is from the Chicago area. Some are ready for change, and some arent. About 80% of ex-offenders from Sheridan come to our offices. Most are African-American, like himself. I work by teaching the job preparedness and training classes, says Coleman. I talk with every individual. I inform them of changes in their community during their incarceration and what services are available to them upon their release. Theyre invited to our office after their release for whatever they need. Sheridan Prison uses the Gateway Foundation and the Safer Foundation to assist inmates with developing social, life and job skills while they are incarcerated, but the role of the community in providing an infrastructure for the returning inmates cannot be minimized. Coleman has witnessed miracles happen through CSACs Overcomers group meetings. The meetings are faith-based; and all are welcome, says Coleman. When I started the meetings in 2004, I wanted to teach from the Bible, but thats not what God wanted. People needed to talkto understand that the power to change was within themselves. Its just awesome to see how people are beginning to understand their own capacity through their own faith. Coleman reflects on the progress of CSAC over the past two years with satisfaction. Weve made a great difference. About 60% of the Austins residents are directly impacted by someone in their family who has been incarcerated. Yet the impact of the change is difficult to measure. He relates a story of a young girl, who considered suicide while her father was incarcerated. Through the support from the CSACs Overcomers meetings, she gained hope and strength to overcome her suicidal thoughts, and now attends meetings with her father at her side. Walter Terry, 34, an ex-offender, who now is drug-free and holds a full-time job at Streetwise says, You have to be active, positive. My job is my foundation. In my spare time, I make meetings. It all plays a part. Its good to talk about your feelings. If you dont deal with your feelings, your feelings will deal with you. Its inspirational, says Sedrick Waller, 45, an ex-offender whose life has totally turned around. The meetings feed the body, mind and spirit. People come from all walks of life looking for a way out. It helped me to keep my commitment to a new way of life, and made me feel like I belonged to someplace. People embrace you for who are you. Its my family outside of my family they let you know youre not alone. Waller, now employed as an ambulance driver, got married and pays rent. God makes a way out of no way. Now, Im giving back to others. Waller was in and out of the penitentiary eight times, and encourages others to have hope. He has also connected six ex-offenders to employment opportunities. Stanley Owens, 27, a student in the last stage of getting his truck-driving license, looks forward to the weekly meetings. Anytime I have questions, I can go to the CSAC meetings for support. You can get good advice; you cant go wrong. Reginald Banks, 39, one of the original members of the Overcomers meetings, now serves as an Outreach Workers at CSAC. It gave me a whole lot of different outlets. I learned how to stay out of prison, and not go back to the old routines, like using and selling drugs. Poinsettias Christmas Cactus

By Andrew Caxton If you are looking for a natural way to decorate your home, you may want to try a Christmas cactus or other plant. Poinsettias are the most popular plant that you see at Christmas time. It makes an excellent Christmas gift for almost anyone that you purchase a gift for and it comes in a wide variety of colors, including yellow, salmon, red, pink, or even a combination of these colors. The more light the cactus gets, the more flowers the cactus will have. A sunny place inside your home is its ideal spot during the winter, but in the summertime you want to place it in a shadier location. Increase the time that your plant spends in the sun each day so that you can adapt it to live outdoors. Between May and September it is best to put your Christmas cactus in the shade. Well-drained soil is recommended for your Christmas cactus. Packaged potting soil is the best option to ensure that it is exactly the right composition for your cactus. If it is warmer outside, then your Christmas cactus will need more water. Water it when the top layer of soil is dry to the touch and keep the pot continually moist. By keeping it moist, you will help to prevent it wilting. If your cactus has blooms all over it, then it does not need water. Leave it without water for four or five weeks after it blooms and then repot it and add fresh new soil. The plant will have new growths by the spring and then it will need some fertilizer. Give it some liquid fertilizer every two to three weeks to help it grow. To help the plant to grow taller and wider, prune it after it blooms. Simply by using your fingers or a sharp knife, you can pinch the stem and remove the sections of each bloom. Root these sections that you removed to help make new plants. If your Christmas cactus has a long and uninterrupted time in a dark spot, then it will bloom more voraciously. You should let it be in darkness from the beginning of October until the start of the holiday season and then you will have lots of flowers. Here is a handy guide for taking care of your Christmas cactus During the month of January, your plant will be full of blooms. February to March you may want to reduce watering. From April to May, you only want to water the plant when the top layer of soil is dry. June to August is when you want to protect your plant by placing it in a shady location. In September and October, your plant will need less light and will enjoy being in a dark, dry, cool place. November and December are the best months for your Christmas cactus to bloom. Isn’t There But One God?

By David Butcher I heard a pastor say, regarding people of the Muslim faith, Too bad they are praying to the wrong God! This was during a Sunday morning sermon. I flinched. Doesnt the Bible say that there is only one God? I believe it does. I found at least six scripture references: Mal 2:10 Have we not all one father? hath not one God created us? why do we deal treacherously every man against his brother, by profaning the covenant of our fathers? Mar 12:32 And the scribe said unto him, Well, Master, thou hast said the truth: for there is one God; and there is none other but he: 1Cr 8:6 But to us [there is but] one God, the Father, of whom [are] all things, and we in him; and one Lord Jesus Christ, by whom [are] all things, and we by him. Eph 4:6 One God and Father of all, who [is] above all, and through all, and in you all. 1Ti 2:5 For [there is] one God, and one mediator between God and men, the man Christ Jesus; Jam 2:19 Thou believest that there is one God; thou doest well: the devils also believe, and tremble. I recall Osama Bin Laden asking, during one of his taped messages, Where was your God . . .? (during the September 11 attacks in 2001). I also recall that only about 10% of the number of people that are usually in the twin towers died that day. Did our God not take care of the other 90%? Did their God not help them in their mission? It seems to me that one God dealt with both factions the best He could and still keep His promises. Does it matter that some call God Jehovah? Should it matter if some label their Lord by the name Buddha, or Mohammed, or Jesus? Should it matter if they refer to the Bible or to the Koran? Is not a rose by any other name still a rose? Are we not all brothers and sisters, regardless of religion, or politics, or color of our skin, or geography? I remember a scene in the movie, “Oh, God!”, in which George Burns, as God, answers a question from religious leaders about Jesus, Mohammed, and Buddha. He stated, as best I recall, “They were all my sons.” Of course, that was just a movie, wasn’t it? I, and my wife, Carolyn Richards, attempt to get the message across during our Christian concerts that “Prayer Works!” Prayer works for everyone, regardless of religion, or politics, or skin color, or sex, or any other physical or emotional difference. It seems to be a law of the universe as surely as the Law of Gravity is. There can be only one “god”, one “force”, one “cosmic consciousness”, or one “higher power” that makes prayer work, regardless what labels we put on it! Perhaps we would all get along better if everyone realized this. The differences here on earth are ours, not God’s. 2004 David M. Jews Should Follow Judaism to Israel!

By David Ben-Ariel Imagine if America’s 5 million plus Jews suddenly decided to follow their religion back to the Jewish homeland, return to Zion, make aliyah (“emmigrate”) to the Promised Land of Israel, putting their faith and prayers into practice! Religious Jews pray daily for the return of the exiles and “Next year in Jerusalem” at Passover. Imagine if American Jewry repented of their hypocritical prayers and put their hearts into such prayers and were moved to actually move to Israel and pray in Jerusalem THIS year! Imagine if America’s many rabbis and Jewish “leaders” would suddenly lead by example and move to the Jewish homeland. From Israel’s national anthem, Ha-Tikvah (the Hope): As long as deep in the heart, The soul of a Jew yearns, And towards the East, An eye looks to Zion, Our hope is not lost … From the ADL’s Yearning for Zion: The two-thousand-year-old daily prayers continually refer to the return to Zion, such as this one from the thrice-daily silent devotion: “And let our eyes behold Thy return in mercy to Zion. Blessed art Thou, O Lord, who restorest Thy divine presence unto Zion.” Among other numerous examples, the return to Zion is included in the grace after meals and Passover Seder tables resonate every year with the refrain “Next Year in Jerusalem.” The seventh blessing of the weekday Amidah prayer is called Ge’ulah (“redemption”) and appeals to the LORD for redemption and deliverance. Behold our affliction and champion our cause, and redeem us speedily for the sake of Thy Name. Blessed are You, Lord, Redeemer of Israel. The Jewish homeland is today in peril. As Gaza goes (with the illegal expulsion of 8500 Jews from their homes, property and businesses), so goes Israel. Dictator Sharon trampled democracy and despised the Jewish inheritance of the Promised Land of Israel and the defeatist Kadima party continues his Judenrein policies. The secular intensify their campaign to further cut Israelis and Jews off from their Hebrew roots and biblical lands, slitting Israel’s throat for sworn enemies who vow genocide against the Jews and plan to pervert Israel into “Palestine!” Why Do So Many Religious Jews Live in America? is a must read! I encourage every American Jew to follow their religion back to the Jewish homeland, fulfilling the mitzva (command/good deed) out of loving obedience to our Great Creator God, the God of the Bible, the God of Israel, and empowering themselves to fulfill many more within the Holy Land, and to help save Israel from self-destruction from those anti-democratic and anti-Semitic men and measures with their love of freedom of speech and religion, having been raised in these Lands of the Covenant (the United States/Menashe) to cherish such God given rights. May faithful Jews not confuse Ersatz New York with Eretz Yisrael! Israel needs American Jews and American Jews need Israel! Let OPERATION SAVE ISRAEL begin immediately and make history and answer prayers and stop the madness in the Jewish homeland!
